Terms of Sales

Iodé Studio was created by Marine Maujean EI with a capital of 1000 euros whose head office is located at 2 Square Saint-Livier 54130 Saint-Max.

Article 1: object

All orders placed on the “Iodé Studio” site are subject to these General Terms and Conditions of Sale (GTC) and assume their prior, express and unreserved acceptance. Iodé Studio reserves the right to adapt or modify these conditions at any time. The version of the GCS applicable to any transaction being that appearing online on the site at the time of the order.

  Article 2 - Customer

The customer declares to be a natural person, at least 18 years old and to have the legal capacity or to hold parental authorization allowing him to place an order on the site. As such, the seller reserves the right, at any time, to ask the customer for proof of identity attesting to his age and/or the authorization of his legal representative.
When registering the customer's personal data in the “my account” section, the latter must ensure the accuracy and completeness of the mandatory data that he provides. In the event of an error in the wording of the recipient's contact details, the seller cannot be held responsible for the impossibility of delivering the product. The seller reserves the right to cancel any order when the customer's IP address is domiciled in a different country from the billing and/or delivery address.

Article 3 – Items sold

The items offered for sale are those described on the site. The seller takes the greatest care in the presentation and description of these products to best satisfy the customer's information. However, it is possible that non-substantial errors may appear on the site (in particular in the description or with regard to the quality of the photos of the products), which the customer acknowledges and accepts.
In any event, in the event of non-compliance of the product delivered with its description on the site, the customer may exercise his right of withdrawal described in article VI below) and the seller will refund the price. (in whole or in part) possibly invoiced, or on the issue of a credit note corresponding to the price of the product(s) concerned.

Article 4 – Price

The prices of our products are indicated in euros, all taxes included for metropolitan France (VAT and other taxes applicable on the day of the order), excluding participation in transport costs in the case of delivery to a member country of the European Union.
Shipping costs are free for metropolitan France except overseas departments.
The customer acknowledges that he may, depending on the country or overseas department of delivery chosen at the time of the order, have to pay customs and/or import duties according to the legislation in force in the said overseas country or department. These rights and sums are not the responsibility of the seller. They will be at your expense and are your sole responsibility, both in terms of declarations and payments to the competent authorities and bodies in your country. We advise you to inquire about these aspects with your local authorities.
The total price of the order (all taxes and shipping costs included) is indicated in the basket. It is payable in full and in a single payment at the time of the order.
The seller reserves the right to modify its prices at any time, but the products will be invoiced on the basis of the prices in force at the time of registration of the order, subject to availability.
The products remain the property of the seller until full payment of the price.
Please note: as soon as you take physical possession of the products ordered, the risk of loss or damage to the products is transferred to you.

Article 5 – Order

You can place an order on the Internet on the site https://iodestudio.com
The contractual information is presented in French and will be confirmed at the latest when your order is validated.
The seller reserves the right not to register a payment, and not to confirm an order for any reason whatsoever, and more particularly in the event of a supply problem, or in the event of difficulty concerning the order received.

Article 6 – Validation of your order

Any order confirmation on the Iodé Studio website entails your full and complete acceptance of these General Terms and Conditions of Sale, without exception or reservation. All the data provided and the recorded confirmation will constitute proof of the transaction. You declare to have full knowledge of it. The order confirmation will constitute signature and acceptance of the operations carried out.
Order taking on the site is subject to compliance with the following procedure put in place by the seller. To validate his order, the customer must imperatively follow the succession of the following steps:
  • Identification and selection of the product(s)
The customer must select a product(s) offered on the site, which will be added to the basket. By validating his basket, the customer initiates the ordering process.
The customer must then identify himself on the site or create an account, specifying his title, surname, first name, billing address and e-mail address. The customer undertakes to communicate the exact data of his identity.
The customer is then informed of the accepted means of payment and any delivery restrictions.
  • Delivery mode selection
The customer only benefits from one delivery method, namely delivery by letter followed by the La Poste service (metropolitan France or European Union), in 1 to 3 working days.
At the time of the delivery step, the customer must indicate the address to which he wishes to be delivered if it is different from the address given in the previous step.
  • Order Summary
A summary of the order will be displayed specifying the essential characteristics of the products, the quantity and the price of the products, the delivery costs and the total amount of the order (delivery costs included).
The customer must read these T&Cs which will be available by means of a hypertext link and tick the box "I accept the T&Cs".
In accordance with the terms of Article L. 221-14 of the Consumer Code, the customer must click on the button "Proceed to payment of the order for validation" validating the order and the GTC ("first click").

Article 7 – Payment of the order

The customer will have the possibility, before definitively validating his order, to check the details of it and its total price, and to correct any errors, before confirming it to express his acceptance. Any order confirmed by the customer constitutes a sales contract and unreserved acceptance of all of the present stipulations.
The customer then selects his method of payment:
  • By credit card: the customer is automatically switched to the electronic payment server of the company Stripe, in its capacity as the seller's payment provider, which is secured by the company Stripe. The customer must enter his bank card number, its expiry date, the name of the cardholder and the visual cryptogram corresponding to the last numbers on the back of his bank card.
By making this payment, the customer guarantees that he is fully authorized to use the payment card for the payment of his order and that this card gives access to sufficient funds to cover all the costs resulting from this order.
By communicating the details of the credit card, the customer accepts that the seller proceeds with the secure transaction.
  • By Paypal: the customer accesses his Paypal payment space to carry out his transaction at Iodé Studio, with the conditions and security standards provided by Paypal.
The data recorded and kept by Iodé Studio constitutes proof of the order and of all past transactions. The data recorded by the payment system constitutes proof of financial transactions.
By clicking on the "Validate Order" button, the customer confirms his order. Confirmation of the order by this "second click" constitutes conclusion of the sales contract.
It is specified that the order is validated and dispatched only after confirmation of the validity of the payment made by the customer.
Order confirmation: a confirmation email summarizing the order (products, price, product availability, quantity, delivery method chosen by the customer, etc.) is sent to the customer by Iodé Studio.
To this end, the customer formally accepts the use of e-mail for confirmation by Iodé Studio of the content of his order. This e-mail acknowledging receipt of the order, details all the essential conditions of the order, namely:
– the order reference;
– the identity and contact details of the customer;
– the nature, quantity and price of the products;
– the total amount of the order (including delivery costs).
In the event that, for any reason whatsoever (exceeding the order ceiling, opposition, refusal of the issuing center to authorize payment, etc.), the debiting of the sums owed by the customer proves impossible, the order will not be registered by the seller who will immediately inform the customer by e-mail.
In any case, the seller reserves the right to refuse any order from a customer with whom there is a dispute or an incident relating to the payment of a previous order or who contravenes the provisions hereof. In this case, the seller will inform the customer by e-mail. If the customer fails to regularize his situation, the seller reserves the right not to process the order.

Article 8 – Availability of a product

In the absence of availability of a product, whether total or partial unavailability, the seller undertakes to inform the customer as soon as possible, either when establishing the order, or after recording the order. and before delivery by email. If this unavailability occurs after placing an order, the seller undertakes to inform the customer by e-mail of the delivery of a partial order or of the cancellation of his order.

Clause 9 –  Order dispatch

Orders are processed within 1-3 days of order confirmation.
It is reminded that the order is sent to the customer only after confirmation of the validity of the payment made by the customer. Once the order has been validated and confirmed, it is sent to the delivery address provided by the customer when ordering. The shipment is the subject of an e-mail sent to the customer under which Iodé Studio specifies:
  • the nature, quantity and price of the products
  • the total amount of the order
  • billing and delivery details

Article 10 – Delivery

Delivery is made to the delivery address indicated by the customer. The main carrier is “La Poste”.
Delivery times are given for information only. Iodé Studio cannot be held responsible for the consequences due to a delay in delivery not being its fault.
In the event of a damaged package (already opened, missing products, etc.), the customer agrees to notify the carrier and Iodé Studio, by any means, of any reservations within 3 days of receipt of the product. In this case, the customer and the seller will jointly consider the follow-up to be made to this incident.
It is recalled that under Article L. 216-4 of the Consumer Code, any risk of loss or damage to the products is transferred to the customer when the latter or a third party designated by him, and other that the carrier proposed by the professional takes physical possession of these products. Iodé Studio is not responsible for disappearances of parcels after official deposit recorded by the carrier. Once your package has been declared delivered, our responsibility is no longer engaged. No refund will be made in this case.

Article 11 – Withdrawal

In accordance with the provisions of Article L.121-21 of the Consumer Code, you have a withdrawal period of 14 days from receipt of your products to exercise your right of withdrawal without having to justify reasons or to pay a penalty.  The customer will inform the company Iodé Studio of its decision to withdraw by means of a declaration by e-mail: contactstudio.iode@gmail.com
Iodé Studio will acknowledge receipt of this withdrawal. Items must be returned new and in their original packaging accompanied by all the accessories delivered including the pouches, thank you card, etc.
It is advisable to add a document with your name, first name, order number and to clearly indicate above the mention “reimbursement”.
Return costs are the responsibility of the buyer. Sending back by "Letter followed" is highly recommended (keep the proof of your shipment carefully). It is up to you whether or not to insure the returned goods. Be careful, however, if the package is lost or stolen during the return, Iodé Studio will not be able to proceed with the refund under the right of withdrawal.
After checking the goods (the items must not have been worn) and finding that they are in perfect condition for resale, Iodé Studio will reimburse the product(s) returned to the buyer within 14 days maximum, at the exception of the return postage which remains the responsibility of the buyer.

Article 12 – Reimbursement

As part of a withdrawal, refunds of products will be made by the seller within a maximum period of 14 days after receipt of the returned products. Reimbursement will be made using the same method of payment chosen by the customer at the time of his order.

Article 13 – Guarantee

All our products benefit from the legal guarantee of conformity and the guarantee against hidden defects, provided for by articles 217-1 to L217-14 of the Consumer Code. In the event of non-compliance with the description on the site of a product sold, it may be returned and refunded.
Furthermore, Iodé Studio cannot be held liable for damages resulting from improper use of the purchased product.
For any complaint about your order, please contact customer service by e-mail at contactstudio.iode@gmail.com within a maximum of 72 hours upon receipt of your package.

Article 14 – Data processing and freedoms

The information collected by Iodé Studio during a customer order is necessary for the management of the transaction and for this purpose may be communicated in whole or in part to the seller's service providers involved in the execution of the order. The customer is informed that these same personal data may also be collected by an organization in charge of analyzing orders and combating credit card fraud. In accordance with the Data Protection Act No. 78-17 of January 6, 1978, the customer has a right of access, rectification, opposition and deletion of data concerning him. He may exercise this right by sending an e-mail to the following address: contactstudio.iode@gmail.com

Article 15 – Personal data 

In accordance with the law relating to data processing, files and freedoms of January 6, 1978, information of a nominative nature relating to buyers may be subject to automated processing.
Iodé Studio reserves the right to collect information on buyers, including by using cookies.
Buyers may object to the disclosure of their details by notifying the company's email address.
Similarly, users have a right to access and rectify data concerning them, in accordance with the law of January 6, 1978.

Article 16 – Archiving of data

The company Iodé Studio will archive the invoices on a reliable and durable medium constituting a faithful copy in accordance with the provisions of article 1348 of the Civil Code.

Article 17 – Intellectual property

All elements of the Iodé Studio site are and remain the exclusive intellectual property of the Iodé Studio company. No one is authorized to reproduce, exploit, redistribute, or use for any reason whatsoever, even partially, elements of the site whether software, visual or sound. Any simple or hypertext link is strictly prohibited without the express written consent of Iodé Studio.
